To remove a chimney from roof level planning permission is not normally required. However building a chimney will require this. Obviously its always best to contact your own council to find out for sure. And if the building is listed or in a conservation area, this will differ. Also, if the chimney breast in mention is shared between a neighbouring property, they will also need to be informed as this goes against the party wall act 1996

planning permission l is not normally required for chimney breast removal unless the building is listed or situated in a conservation area. However, a Building Regulations application is required when some but not all of a chimney is removed you can remove sections as long as correct steels are in place for support
